1About these terms

These terms of use govern your access to and use of togvia.com and the Togvia service (together, "Togvia", "we", "us" or "our"). By creating an account, joining a trip or otherwise using the service, you agree to these terms. If you do not agree with them, please do not use Togvia.

Please read them alongside our Privacy Policy, which explains what information we hold about you, and our Cookie Policy, which explains what we store on your device.

2What Togvia is

Togvia is a travel research and planning tool. It helps a person or a group gather ideas about where to go, compare them, agree on a shortlist, and turn that shortlist into a realistic day-by-day itinerary that accounts for opening arrangements and travel time between stops.

Alongside the planning tools, Togvia publishes destination information: country guides, places worth visiting, and ready-made itineraries you can copy and adapt.

What Togvia is not

We are not a travel agent, tour operator, booking service or payment processor. We do not sell tickets, take payments, hold reservations, arrange transport or accommodation, or act as anybody's agent. Where Togvia shows a venue, a price indication or a link, it is presenting information we hold about that place. Any booking, payment or travel arrangement you make is entirely between you and the venue, operator or retailer concerned, on their terms.

Togvia does not provide medical, legal, financial, insurance, visa or safety advice. Nothing on the service should be relied upon as such.

3Eligibility and your account

Togvia is intended for adults. By using the service you confirm that you are able to enter into a binding agreement in your country of residence.

• Keep your password confidential. Activity carried out through your account is treated as having been carried out by you.
• Choose a display name your travelling companions will recognise. You are not required to use your legal name.
• Give accurate contact details, and keep them up to date, so that account recovery and service messages reach you.
• Tell us promptly at support@togvia.com if you believe somebody else has gained access to your account.

You may also use parts of Togvia without an account, or by joining a trip through an invitation link. A trip created without an account is held against the browser you created it in and is not recoverable if that browser session is lost. Creating a free account protects it.

4Planning with other people

Trips on Togvia are shared spaces. When you join a trip, the other members of that trip can see your display name, the places you add, how you voted on each suggestion, and anything you write in shared notes, checklists and messages. Voting is deliberately not anonymous — seeing who preferred what is the point of it. Do not put anything into a shared trip that you would not want the whole group to read.

Anybody holding a valid invitation link can join the trip it belongs to. Send invitations only to people you intend to include, and revoke an invitation immediately if it reaches the wrong person.

The owner of a trip may delete it. Deleting a trip removes it for every member, including their notes, votes and plan.

You are responsible for the content you contribute to a shared trip, and for treating other members respectfully.

5Travel information and checking before you go

Destination information on Togvia is researched and, where a source and a checked-on date are recorded, both are shown on the page. Even so, published information describes a past check, not a live feed. Opening hours change. Venues close for maintenance, events, holidays and permanently. Last admission is frequently earlier than closing time. Transport is disrupted. Weather closes outdoor attractions without notice.

Where we have not been able to confirm a detail, we say so rather than presenting a plausible substitute. A detail marked as unconfirmed in your plan is telling you something real: it has not been verified, and you should check it yourself.

Estimated journey times, suggested visit durations and daily itineraries are planning estimates produced from the information we hold. They are not guarantees, and they cannot account for local conditions on the day.

To the extent permitted by law, we are not responsible for a journey made to a closed venue, a missed admission, or a plan disrupted by circumstances outside our control.

6Acceptable use

You agree not to use Togvia to:

• harass, threaten, defame or abuse anybody, including other members of your own trip;
• post or share content that is unlawful, hateful, obscene, or that you have no right to share;
• impersonate another person or misrepresent your association with anybody;
• access, or attempt to access, another person's account, trip, invitation or data;
• probe, scan, overload, disrupt or attempt to circumvent the security of the service;
• scrape, harvest or extract the service's content in bulk, or use automated means to access it other than a well-behaved search engine crawler acting within our published rules;
• copy, republish or redistribute Togvia's published destination content commercially without our written permission;
• use the service in breach of any applicable law or regulation.

We may suspend, restrict or remove an account that breaches these rules, and we may remove content that does.

7Content you contribute

Your notes, messages, place suggestions, votes and other contributions remain yours. You keep ownership of them.

You grant us a non-exclusive, worldwide, royalty-free licence to store, reproduce and display that content solely for the purpose of operating the service — that is, running your trip and showing your contributions to the people you have shared it with. This licence exists only so the product can work, and it ends when you delete the content or your account.

We do not use what you write to train models, and we do not use it to advertise to you.

You confirm that you have the right to share anything you contribute, and that doing so does not infringe anybody else's rights.

8Our content and intellectual property

Togvia, the Togvia name and logo, the site design, the software, and the published destination guides, place descriptions and ready-made itineraries are owned by us or licensed to us, and are protected by intellectual property law.

You may use them for your own personal, non-commercial trip planning: read them, save places, copy an itinerary into your own trip, and print or share a plan with the people travelling with you. Anything beyond that — republishing, reselling, systematic copying, or building a competing product from our content — requires our written permission.

Photographs are used under the licences recorded for them. Attribution for every published image is listed on the image credits page. If you believe content on Togvia infringes your rights, write to support@togvia.com with enough detail for us to identify it and we will investigate.

9Third-party sites and services

Togvia links to venues, transport operators, mapping services, ticket sellers and official tourism sources. Those services are not operated by us. We do not control their content, their availability, their prices or their terms, and we do not endorse them by linking to them.

Your dealings with a third party — including any booking, purchase, cancellation or refund — are between you and that third party, under their terms and their privacy policy. Please read them.

10Availability and changes to the service

We work to keep Togvia available, accurate and secure, but we do not promise that it will be uninterrupted, error-free, or complete. Access may be suspended for maintenance, for technical reasons, or because of events outside our reasonable control.

We may add, change, restrict or withdraw features. Where a change materially reduces something you rely on, we will give reasonable notice if we can.

Keep your own copy of anything you cannot afford to lose. You can export your data at any time from your account page.

11Ending your account

You may stop using Togvia at any time, and you may delete your account from your account page. What happens to trips you shared with other people is set out in the Privacy Policy.

We may suspend or end your access if you materially breach these terms, if we are required to by law, or if we discontinue the service. Where we do so and the reason permits it, we will tell you why and give you an opportunity to retrieve your data.

The sections on content, intellectual property, disclaimers, liability and governing law continue to apply after your account ends.

12Disclaimers

Togvia is provided "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties, conditions and representations that are not expressly stated in these terms — including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement.

In particular, we do not warrant that destination information, opening arrangements, prices, journey times or itinerary suggestions are complete, current or free from error, for the reasons set out in Travel information and checking before you go.

13Limitation of liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. Nothing in these terms affects your statutory rights as a consumer.

Subject to that, and to the fullest extent permitted by law:

• we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, data, goodwill or anticipated savings;
• we are not liable for loss arising from a travel decision taken using the service, including a missed booking, a closed venue, a wasted journey, a disrupted itinerary or an additional cost incurred;
• we are not liable for the acts or omissions of any venue, operator, carrier or other third party;
• we are not liable for loss caused by content contributed by another user of the service.

Togvia is provided free of charge. Where liability cannot be excluded, our total aggregate liability arising out of or in connection with the service is limited to £100.

14Governing law

These terms, and any dispute or claim arising out of or in connection with them, are governed by the law of England and Wales. The courts of England and Wales have non-exclusive jurisdiction.

If you are a consumer resident elsewhere, you keep the benefit of any mandatory protections given to you by the law of your country of residence, and you may bring proceedings in your local courts where the law entitles you to.

15Changes to these terms

We may update these terms from time to time — for example, to reflect a change to the service or to the law. The current version is always published on this page, with the date it was last updated shown at the top.

Where a change is material, we will take reasonable steps to bring it to your attention. Continuing to use Togvia after a change takes effect means you accept the updated terms.
